Terms of Service

Welcome to OpenCaddie. These Terms of Service (the “Terms”) are a binding agreement between you and OpenCaddie LLC, a California limited liability company (“OpenCaddie,” “we,” “our,” or “us”), governing your access to and use of the website opencaddie.ai and the related software, apps, and services we provide (the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Accounts

You may need to create an account to access certain features. You agree to provide accurate information during signup, to keep your account credentials secure, and to notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

3. Free and Pro Plans

OpenCaddie offers a Free plan and a paid Pro plan. The Free plan includes core features with monthly usage limits (see opencaddie.ai/pricing for current details). The Pro plan removes those limits and unlocks Pro-only features. If you subscribe to Pro:

  • You authorize us (or our payment processor, Stripe, Inc.) to charge your selected payment method for the applicable fees at the price disclosed at the time of subscription.
  • Subscriptions renew automatically at the end of each billing period unless you cancel before renewal.
  • You may cancel a Pro subscription at any time from Settings → Billing (which opens the Stripe customer portal). Cancellation takes effect at the end of your current billing period and you retain Pro access through that period.
  • Fees are non-refundable except where required by law. If you believe you have been charged in error, contact support@opencaddie.ai within fourteen (14) days and we will review the charge in good faith.
  • If you cancel or your subscription ends, your account automatically reverts to the Free plan. Your data (shots, rounds, plans, progress) is retained.

4. Your Data

You retain ownership of all golf data you upload to the Service, including shot data, round data, swing metrics, and notes (collectively, “Your Data”). You grant us a limited license to host, process, and analyze Your Data solely to provide the Service to you. Our handling of Your Data is described in our Privacy Policy.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to reverse engineer, decompile, or extract source code from the Service.
  • Upload data you do not have the right to share, including other people’s personal data without consent.
  • Use automated tools (bots, scrapers, crawlers) to access the Service except where we explicitly permit it.
  • Resell, sublicense, or commercially exploit the Service without our written permission.
  • Interfere with or disrupt the Service or its underlying infrastructure.

6. AI-Generated Content

The Service uses large language models to generate coaching advice, practice plans, and drill recommendations (collectively, “AI Output”). AI Output is generated automatically and may be inaccurate or unsuitable for your circumstances. AI Output is not professional coaching advice and is not a substitute for instruction from a licensed golf professional or medical advice. You use AI Output at your own risk.

7. Third-Party Services

The Service relies on third-party providers, including but not limited to OpenAI for language model inference, Supabase for data hosting, Vercel for deployment, and Stripe for payment processing. Your use of the Service is also subject to those providers’ terms where applicable. We are not responsible for the actions or omissions of third parties.

8. Intellectual Property

The Service, including its design, code, brand marks, drill library, and editorial content, is owned by OpenCaddie LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission. You may share screenshots or descriptions of the Service for personal, non-commercial purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF AI OUTPUT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OPENCADDIE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold OpenCaddie LLC and its officers, employees, and agents harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of applicable law or third-party rights.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms or if we cease to operate the Service. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The “Last updated” date at the top of this page reflects the most recent revision.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.
